By accessing or using Wanderseek (“the Service”), you agree to be bound by these Terms & Conditions. The Service is operated by Three Monkeys Online Sdn. Bhd. (202101008046 / 1408345-P), incorporated in Malaysia. If you do not agree, please do not use the Service.

1. Acceptance of Terms

Your continued use of Wanderseek constitutes your acceptance of these Terms. These Terms apply to all visitors, registered users, and business partners. We may revise these Terms at any time; the revised version becomes effective when posted on this page.

2. Use of Service

Wanderseek is a community map for discovering and sharing local places in Penang, Malaysia. You agree to:

• Use the Service only for lawful purposes
• Submit accurate and honest information about places and businesses
• Not use the Service to spam, harass, solicit, or advertise without authorisation
• Not attempt to scrape, reverse-engineer, or disrupt the Service
• Comply with all applicable Malaysian laws including the Communications and Multimedia Act 1998

3. User Content

You retain ownership of all content you submit (“User Content”). By submitting content, you grant Three Monkeys Online Sdn. Bhd. a non-exclusive, royalty-free, worldwide licence to display, distribute, and use that content as part of the Service. You confirm your content does not infringe any third-party rights and that you have the right to share it.

We reserve the right to remove any content that violates these Terms without prior notice.

4. Community Guidelines

Wanderseek is built on the trust of its community. We expect all users to:

• Be respectful and civil toward other users and businesses
• Submit only accurate place information — do not create fake listings or misleading reviews
• Not post content that is defamatory, abusive, obscene, or discriminatory
• Not impersonate any person, business, or organisation

5. Account Termination

We reserve the right to suspend or permanently terminate any account that violates these Terms or that we determine, in our sole discretion, is engaged in abusive behaviour. Termination may occur without notice for serious violations. You may close your account at any time by contacting us.

6. Wanderseek Points & Rewards

Wanderseek Points (“WP”) and redeemable credits are part of a loyalty programme operated by Three Monkeys Online Sdn. Bhd. They are earned solely through activity in the Service (such as check-ins, reviews, and community posts), cannot be purchased with money, have no cash value, are not transferable between accounts, and do not constitute electronic money, a deposit, or any other regulated financial product. Points may only be exchanged for the rewards listed in the in-app rewards catalogue, subject to availability, stock limits, per-user limits, and tier requirements shown at the time of redemption.

eWallet reload rewards.Where a reward is fulfilled as a Touch ‘n Go eWallet reload, the transfer is made manually to the Malaysian mobile number you provide at redemption. The full name you provide must exactly match the name registered to that TNG eWallet account — this is how we verify the reload reaches the right person. If the name and number do not match, or the details cannot be verified, the transfer will not be made and your credits will be returned to your balance. Reloads are normally completed within 24 hours and in any case within 3 business days.

Points earned through fraud, manipulation, automation, or abuse of the earning rules are void and may be removed; related redemptions may be reversed and the account suspended (Section 5 applies). We may adjust earn rates, reward prices, stock, and the catalogue, or modify or discontinue the programme, at any time; where reasonably practicable we will give notice of material changes. On programme termination or account closure, unredeemed points lapse without compensation. Personal data collected to fulfil a redemption (your name and eWallet mobile number) is used only for that purpose and handled in accordance with our Privacy Policy.

7. Limitation of Liability

Wanderseek provides community-sourced information only — it is not a substitute for professional advice. To the maximum extent permitted by Malaysian law, Three Monkeys Online Sdn. Bhd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data, revenue, or business opportunities. Place information (hours, menus, prices) may be outdated — always verify directly with the business.

8. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

9. Changes to Terms

We may update these Terms from time to time. We will update the “Last updated” date at the top of this page when changes are made. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
